By visiting JuiceBoxJungle.com (the "Site") and/or by downloading, embedding, posting, viewing, using or forwarding any Content (defined below), you accept and agree to be bound by these terms & conditions (the "Agreement"). Please read them carefully.

Posting and Transmitting Content

The Site consists of a mix of digital media, video, written content, video players, advertising, statistics, polls, posts, text, widgets, applications and/or games provided by JuiceBoxJungle, our users and our partners, whether by posting on the Site directly or indirectly via an RSS feed or otherwise, on other sites via a JuiceBoxJungle video player or widget (together, the "Content"). You are responsible for all Content that you post on or transmit through the Site, embed or post on your own site, and/or forward or share with others. The following Content is prohibited:

• Copyrighted material and trademarks that are used without the express permission of the owner
• Advertisements, promotions, solicitations or offers to sell any goods or services for any commercial purpose unless you have JucieBoxJungle’s written consent to do so
• Content that discloses or contains any personally identifying information beyond a first name about any person
• Content in which you impersonate another person or entity, including Content in which you falsely claim to be a Site moderator or other official
• Pornographic, sexually explicit or obscene Content
• Content that exploits children or minors
• Content that we have reason to believe was posted for malevolent purposes, including libel, slander, defamation or harassment
• Content that may be deemed offensive to the Site community, including, but not limited to, blatant expressions of bigotry, prejudice, racism, hatred or profanity
• Content promoting or providing instructional information about illegal or illicit activities
• Content that transmits or contains viruses, corrupted files, or any similar element

We examine the Content on the Site on a regular basis and we maintain the absolute right (though not the obligation) to remove any Content that does not meet the standards listed above or that is otherwise objectionable at our sole discretion. Nonetheless, you understand that by using the Site, you may be exposed to Content that you find offensive or objectionable.

By utilizing the Site and any Content, you agree to provide true, accurate, current and complete information about yourself as prompted by the subscription form, sign up form and/or any registration form. If any information provided by you is untrue, inaccurate, not current or incomplete, JuiceBoxJungle reserves the right to terminate your subscription and refuse any and all current or future use of the Site.

JuiceBoxJungle assumes no responsibility for the deletion or failure to store postings, links, thumbnails, contributions or other information submitted by you or other users to JuiceBoxJungle.

By utilizing the Site you agree to indemnify, defend and hold JuiceBoxJungle, and its officers, directors, employees, agents, and affiliates harmless from and against any and all liability, losses, costs, and expenses (including attorneys' fees) incurred i) through your use of the Site, or ii) as a result of Content you post on your own site, submit or transmit through the Site or share or forward to others in violation of these Terms.

Grant of License.

When you post or transmit Content on or through the Site or on your own site, or embed JuiceBoxJungle video players and/or widgets into your blogs or sites, you grant the Site and JuiceBoxJungle, and its affiliates and partners, a nonexclusive, perpetual, irrevocable, worldwide, sub licensable, royalty-free license to download, transmit by RSS feed, grab, use, store, display, publish, transmit, transfer, distribute, reproduce, aggregate your Content with other Content, create derivative works of and publicly perform that Content for any purpose on and through each of the services provided by the Site or on other sites owned by JuiceBoxJungle or its affiliates or partners. This license shall apply to the distribution and the storage of your Content in any form, medium, or technology now known or later developed. In the event of a sale of or consolidation of the Site with another business, we may transfer some or all of your Content, and assign this license, in order that the service being provided to you may continue or for other business purposes.

Ownership of Intellectual Property

Unless otherwise noted, all Content and any other content included on the Site, such as text, graphics, images, videos, statistics, poll results, games, applications, widgets, digital downloads, data compilations, and software, is the property of JuiceBoxJungle or its content suppliers and is protected by United States and international copyright laws. JuiceBoxJungle is a trademark of Philissaty, Inc. d/b/a JuiceBoxJungle and any references to the JuiceBoxJungle entity herein shall be deemed to apply equally to Philissaty, Inc. JuiceBoxJungle and its affiliates respect the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please communicate with us by letter to us at our address listed below.

Site Access and Use of Content

JuiceBoxJungle grants you a limited license to access and make personal use of this Site and the Content. Except where indicated we do not grant you permission to download or modify any portion of the Site or the Content or metatags without our express written consent. This license does not include any resale or commercial use right to the Site or the Content; any collection or use of any statistics, poll results, product listings, descriptions, or prices.

Electronic Communications and Submitted Materials

When you register or subscribe on the Site, and/or embed, share or interact with any Content, you consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on the Site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

The Site and Content Does Not Provide Medical Advice.

Our Site and Content is intended to provide entertainment and general information about parenting and to provide parents with an online community for the sharing of general advice and ideas. The Site and the Content is not engaged in the provision of medical or diagnostic information. Content should be considered as opinion only and should not be taken as a substitute for qualified medical or other professional advice from a qualified service provider. Links to Third Party Sites

You may be able to access third party sites and blogs through JuiceBoxJungle.com or the Content wherever it resides ("Linked Sites"). Linked Sites are not, however, reviewed, controlled, or examined by us in any way and we are not responsible for any such Linked Sites, or any additional links contained therein. It is your sole responsibility to comply with the appropriate terms of use of the Linked Sites. In no event shall JuiceBoxJungle be liable, directly or indirectly, to anyone for any loss or damage arising from the use of the Linked Sites.

Disclaimer of Warranties and Limitation of Liability

Applicable Law and Disputes

By visiting JuiceBoxJungle.com and/or viewing any Content, you agree that the laws of the state of New York, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and JuiceBoxJungle or its affiliates. This Agreement shall be construed in accordance with the laws of New York, without regard to any conflict of law provisions. The state and federal courts of the State of New York, County of New York shall resolve any dispute relating to this Agreement.

Site Policies, Modification, and Severability

We reserve the right to make changes to our Site, policies, and this Agreement at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

Privacy Policy

This Privacy Policy describes the use of personally identifiable information about you that we collect through JuiceBoxJungle.com (the "Site"). This Privacy Policy does not apply to any other data, including, without limitation, data that we collect through social networks or the use off the Site of widgets, applications, games, polls, video players etc. or data that others collect on websites that are linked to the Site.

Types of Data Collected
You send information to us when you sign up with us to be a member on the Site, subscribe to emails, participate in surveys, polls or promotions, download applications or games from our Site, embed or download video players or widgets, post comments on the Site, respond to us or otherwise contact us. Depending on your choices, you may send us personally identifiable information such as your email address, name, mailing address, phone number, birthday, and gender; password; baby due date/birthday, name and gender, children, and other information.  But, you can also use certain features of our Site or embed content from our site without telling us your name and if you do not tell us who you are, we do not try to find out.

We also track information about how our Site is used by you through cookies, Internet tags or web beacons, and navigational data collection (log files, server logs, clickstream).   In addition, the ad networks that we participate in collect anonymous information using cookies to target some of the advertising you see on the Sites and on other third party websites.  If you have actively sent us your name or other personally identifiable information, we may combine such information with tracked information for the purposes set forth below.

Data Use
We collect information about you because we want to determine what you may like or find interesting, so we can provide you with targeted information and advertising (on our Site, in newsletters, via email and otherwise). In addition, we use data to create statistics and reports where personally identifiable information has been removed and aggregated (such that it is anonymous as regards any specific user) for various business purposes.

•    Even though we do not provide any personally identifiable information about you specifically to any advertising customers, If you choose to respond to targeted advertisements that mention one of our advertisers, the advertiser may deduce that you are a member of the target audience to whom we sent the ad.
•    If you sign up for our services on a third party website, such third party may know that you signed up on our Site.
•    We freely use and disclose data in anonymous form, for example, in statistics or reports to our advertising customers.
Security
We take reasonable steps to protect personally identifiable information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. But, you should keep in mind that no Internet transmission is ever completely secure or error-free. In particular, e-mail sent to or from the Sites may not be secure.
About Children
The Site is not intended for children under the age of 13. We do not knowingly collect personally identifiable information via the Site from visitors in this age group. We do, however, collect information about children and babies from their parents. We ask that our users not provide information about a baby or child without first getting the parents' consent.

This Privacy Policy is effective January 1, 2009.  We reserve the right to amend it from time to time and if we change it materially, we will post a revised version on the Sites.
